The Coalition for Public Health and Social Justice, has sued 15 institutions over the mandatory Covid-19 vaccination and restrictions on movement in some state facilities.
The respondents included; Attorney General, Ghana Health Service, the Speaker of Parliament, Electricity Company of Ghana, Passport Office and the Ghana Immigration Service.
The rest are; Takoradi Technical University, University of Health and Allied Sciences, Ministry of Health, Accra Metropolitan Assembly, University of Cape Coast.
Others included; National Sports Authority, Ghana Broadcasting Corporation, University of Ghana Medical School and the Ghana Infectious Disease Centre.
In the suit, the lawyer for the Coalition, Benjamin Zigorsh, is praying the court to declare the vaccine mandate as a breach of Article 21 (1) (g) of the 1992 Constitution of Ghana.
He stated that the impugned directives violate section 2 (1) of the imposition of Restrictions Act, 2020 (Act 1012) and sections 22 and 30 of the Public Health Act, 2012 (Act 851) which he noted is illegal.
The suit pointed out that directives by the respondents contravene the guidelines of the World Health Organisation(WHO) regarding proof of Covid-19 vaccination for international travellers which is unreasonable.
The suit, further stated that the directives by the respondents, contravene medical ethics and best practices that govern Covid-19 vaccine administration.
It added that the guidelines of the Food and Drugs Authority on the administration of emergency use authorised medical products are unreasonable.
The suit noted that the mandatorily required to provide proof of Covid-19 vaccination before one can enter or access the premises of respondents as illegal and infringes on the right to freedom of movement.
“Checks at the Assembly Press as at the time of this suit, showed that the President of Ghana has not issued any Executive Instrument imposing Covid-19 vaccination restrictions on the right to freedom of movement. Neither did the impugned directives of the respondent make any reference whatsoever to any such Executive Instrument”. It stated.
The Coalition is, therefore praying the court to declare quashed the directive because the mandatory vaccination is unconstitutional and not having legal backing.
