Letter Of Retraction And Apology

Between the 8th day of September, 2011 and the 25th of September, 2011, we published several Articles concerning Sir Sam Jonah under the following captions:
(i) 5th day of September to Thursday, the 8th day of September, 2011 inclusive, Edition number 64/11, published an Article captioned:

“Sam Jonah in Big Trouble
…for demolishing one million dollar house”

(ii) September 9 to Sunday, September 11, 2011 inclusive, the Newspaper published in its 65/11 Edition, another Article on pages (1), five (5) and fourteen (14) with the headline:

“One million dollar house demolition
Sam Jonah is vicious”

(iii) September 16 to Sunday, September 18 inclusive, in its 67/11 Edition in the top right corner of its page one (1) as follows;

“Sam Jonah’s Lawyer goofs on one million dollar house demolition”

(iv) September 19 to Thursday, September 22, 2011 inclusive , in its 68/11 Edition, published at page one (1), under a caption of and concerning the Plaintiff as follows;

The Herald Owes Nobody an Apology”
At the top right-hand corner of the said Edition, at page one (1) under a caption of and concerning the Plaintiff as follows;
“- COMMING UP- (sic)
Immortal Sam Jonah and His Property Grabbing Skills”
(v) Friday, September 23, to Sunday , September 25, 2011 inclusive, 69/11 Edition at the top right-hand corner, at page one (1), by publishing of and concerning the Plaintiff under the captions as follows;
“- COMMING UP- (sic)

Immortal Sam Jonah and His Property Grabbing Skills”
On the same page one (1), at the bottom right-hand corner, of and concerning the Plaintiff under the caption as follows;

… In The US$ 1Million House Demolition Saga”

The effect of the above mentioned publications created the poor impression that Sir Sam Jonah had engaged in fraudulent and corrupt practices with respect to the administration of justice.

The publications additional claimed that Sir Sam Jonah had an envious streak and devoted his time to destroying the efforts of successful businessmen.

At the time of the publications, we fail to ensure that same were based upon reliable information.

Further investigations have shown that we were wholly wrong and that there were no basis for the allegations made in the various publications.
We accept that the grave allegations that were raised in the publications were completely false and totally defamatory of Sir Sam Jonah.

Upon hindsight, we realize that we should not have published them.

It is a matter of fact, that Sir Sam Jonah is an outstanding businessman, having played a key role in several sectors of international finance with special emphasis on the mining and investment industries. In all his business dealings, sound ethics have been a guiding factor. It was in recognition of his many achievements that Her Majesty Queen Elizabeth II conferred on Sir Sam Jonah an Honorary Knighthood as Knight Commander of the Civil Division of the Most Excellent Order of the British Empire.

We regret that these publications were ever made hereby RETRACT THE ABOVE MENTIONED PUBLICATIONS AND APOLOGISE for the distress and embarrassment caused to Sir Sam Jonah.

In addition, we have removed from our website, www.theheraldghana.com the said publications and the offensive commentary made by our readers.

We undertake not to carry out any further publications or cause to be published whether by ourselves, servants and agents the words complained of or any similar words defamatory of Sir Sam Jonah.
